Club Gaming Permits and Club Machine Permits
Club Gaming Permits and Club Machine Permits (replacing part II and part III registrations under Gaming Act 1968)
- Club Machine Permit – can have up to 3 x category B4 machines (stake £1, prize £250)
- Club Gaming Permit – (as above plus facilities for equal chance gaming and such games as are prescribed by Secretary of State)
- Application must be in the prescribed form and manner and accompanied by information and documents and fee. Within the prescribed time copy of application must be sent to the Gambling Commission and police, who can object in the prescribed time and manner
- The licensing authority can grant or refuse. Grounds for refusal include if it is not a members’ club, if it is used wholly or mainly by children, if applicant has committed an offence or there has been a breach of conditions, permit been cancelled or an objection has been received
- Before refusing the licensing authority must hold a hearing
- Licensing authority can dispense with a hearing if the applicant and person making an objection agree
- Where permit is granted the licensing authority must give notice of the decision and issue. The Licensing authority may not attach conditions
- Will be subject to Gambling Commission’s Code of Practice for gaming machines in club premises (tba)
- If application is rejected licensing authority must give notice of decision and reasons to applicant, Gambling Commission and police
Fast track procedure
- Applies to applicants with a Club Premises Certificate under the Licensing Act 2003
- In this case do not need to consult and grounds for refusal is limited
- Licensing authority will issue unless premises is provided mainly for gaming or has been cancelled
- Form of permit prescribed
- If fast tracked permit will include Club Premises Certificate
- Shall keep copy on premises and disclose when asked by police &/or Licensing authority
- Lasts 10 years but must pay annual and renewal fee
- Will be arrangements for variations, if lost, stolen or damaged
- Appeals to Magistrates
