VALP Examination – Main Modifications Consultation Closed

Please note: this is not the latest Further Main  Modifications page . The information below is about the Main Modifications consultation (5 November – 17 December 2019) and the position updates that followed in 2020. This page will not be updated. Please do not comment on the 2019 Main Modifications.

Following the hearing sessions into the Vale of Aylesbury Local Plan (VALP) in July 2018, the publication of the Inspector’s Interim Findings in August 2018, as well as further discussions with the VALP Inspector, the council has prepared a number of Main Modifications which are considered necessary to make VALP sound. Their content has been agreed with the Inspector and were put forward for public consultation which closed on the 17 December.

The council are now processing the responses received, once this has been done the responses will be available to view on the Aylesbury consultation portal. The council are also preparing a response to the representations for the inspector. The inspector will then consider the representations and the council’s response to determine whether he can find the plan sound and prepare his final report.

It's intended that the plan will be adopted during as soon as possible during  2021, but the timeline will be dependent on how long the Inspector needs to consider the Further Main Modifications representations and whether he chooses to hold more public hearing sessions prior to producing his final, binding report.

VALP Update December 2020 

The representations to the Main Modifications consultation have now been published. These can be found in the upgraded consultation portal. Those who commented via the portal will notice the upgraded system looks different but all information from previous consultations is still available.

The Council has also published reports of the representations on the Examination Documents page as ED261 and ED262. The Council has also published a schedule of responses to the issues raised in the Main Modifications consultation, which can also be found on the Examination Documents page as ED263 and ED264.

VALP Update October 2020 

The second batch of information was sent to the inspector at the beginning of October, the officer decision relating to this is on the Council's website. The responses in this batch largely relate to transport matters, but also cover those affected by the revised housing delivery information. We had anticipated the second batch to the inspector would include all the remaining information and documents, but there are still some areas where work is being finalised. These are work on C2 housing for older people, further transport modelling and an update to the Habitats Regulation Assessment (HRA) as a result of the further traffic modelling. These are expected to be concluded shortly and will be sent to the inspector as a third and final batch as soon as possible. As set out previously, once the inspector has received all the information it will be uploaded to the website as examination documents and he will decide the next stages of the examination. 

VALP Update September 2020

As requested by the inspector, the council is producing responses to the issues raised in the main modifications consultation which took place late last year. As set out in previous updates, during the consideration of the issues raised in representations earlier this year, it was identified that further transport modelling should be carried out to support the existing evidence base. As well as this, additional work has also been carried out to take account of the latest year of monitoring data and most recent information about expected housing delivery. This will also be submitted to the inspector.

This process is nearing completion, and the responses are being sent to the inspector in batches for his consideration, along with the additional documents. Batch one has already been sent to the inspector, and the officer's decision relating to this is on the Council's website.

It is currently anticipated that the remaining responses and other documents will be submitted to the inspector before the end of September, but please continue to check this page for updates. The documents submitted to the inspector will be published as examination documents on the website once they have all been received by him.

The Council considers that a small number of further modifications will be required to address issues raised in the representations and to address other issues which have arisen outside the examination process. It is likely that some of these will be further main modifications, which would then be subject to consultation, but this is decided by the Inspector.

After considering the council's responses, the inspector will then decide on the next stages of the examination. This could include further consultation/reopening of the hearing sessions, or the inspector may proceed straight to writing his final report. The council will not be able to engage in relation to the representations until the inspector indicates how he wishes to proceed. Again, the website will be updated as further information becomes available.

VALP update 11 March 2020

The Council has been considering its responses to the representations made on the VALP main modifications.  The Council was asked by the Inspector to include modifications to clarify the infrastructure that is critical to the VALP delivery. In considering the relevant representations, the Council has come to the conclusion that it is necessary to request some further transport modelling to support the existing evidence base.

This additional modelling will take approximately four weeks, and once this is complete, the representations and the Council’s responses will be sent to the Inspector.  We anticipate this being in mid-April.  Beyond that, the Inspector has already indicated that, due to other commitments, he is unlikely to be in a position to consider representations and the Council’s responses until June 2020.

We appreciate that this additional essential modelling will cause a slight delay to the finalisation of VALP but we consider that it is appropriate to do this work now so that the Inspector has all the relevant information when considering the representations on the main modifications and the Council’s responses to them.

VALP update w/c 30 March 2020

We had intended to send the representations and the Council’s responses to the issues raised in them to the Inspector in mid-April.  However the Council has prioritised its response to the current Covid-19 crisis and as a result some Council officers involved in preparing the responses to the representations have now been seconded to Covid-19 work. It is therefore not possible to give a definitive answer at this stage as to when we will be in a position to send the information to the Inspector, but we will continue to focus on achieving this as soon as possible and more information will be put on the website when it is available.

The consultation took place over a six week period and representations were invited to the Main Modifications as well as the associated Sustainability Appraisal and Habitats Regulations Assessment. Please note this was not an opportunity to make comments on any other aspect of the Local Plan. Only representations to the Main Modifications, Sustainability Appraisal and Habitats Regulations Assessment will be forwarded to the Inspector. The documents can be viewed below:

The Core Documents List is an assisting document that sets out all the documents relevant to the consultation. The main modifications proposed to VALP that were consulted on are summarised in the Summary of Main Modifications.

The council has also prepared Additional Modifications which are minor changes that do not relate to the Plan's soundness. Representations  that were made to the Additional Modifications or to other parts of VALP that are not affected by main modifications will not be forwarded to the Inspector as duly made comments. Evidence for Main Modifications

To aid understanding of the effect of the modifications on the content of the submission VALP the council has produced a ‘tracked change’ version of the plan showing the Main Modifications and Additional Modifications in context.

The consultation period ran from 12:00 pm on the 5th November to 5.15 pm on the 17th December 2019.

Representations received after this date will not be taken into account by the council in responding to comments but will still be passed to the inspector as a late comment for his awareness.
